1. Acceptance of Terms

By accessing and using the ElkPackPro website (the "Site") and purchasing our products or services, you ("Customer", "you", or "your") agree to be bound by these Terms and Conditions ("Terms"). If you do not agree with any part of these Terms, please do not use our Site or services.

These Terms constitute a legally binding agreement between you and ElkPackPro ("we", "us", or "our"), a custom packaging manufacturer headquartered in Xiamen, Fujian, China.

2. Definitions

• "Products" refers to custom packaging items including but not limited to paper bags, paper boxes, gift boxes, shopping bags, food packaging, and related items manufactured by us.
• "Inquiry" refers to a request for quotation submitted through our website forms, live chat, email, or other communication channels.
• "Order" refers to a confirmed purchase agreement between you and us for specific Products.
• "MOQ" refers to Minimum Order Quantity, the smallest quantity we accept for production.
• "Lead Time" refers to the estimated production duration from sample confirmation to product completion.

3. Products and Services

3.1 Product Information

All product descriptions, specifications, images, and pricing displayed on our Site are provided for general information purposes. While we strive for accuracy, we do not warrant that product descriptions, colors, dimensions, or other details are entirely accurate, complete, or current. Actual product colors may vary due to monitor settings and printing processes.

3.2 Customization

We specialize in custom packaging solutions. Custom Products are manufactured according to agreed-upon specifications including dimensions, materials, printing, and finishing. Any deviation from confirmed specifications must be reported within 7 days of receipt.

3.3 Minimum Order Quantity (MOQ)

Our standard MOQ starts from 500 pieces for most Products. MOQ may vary by product type, material, and customization level. Specific MOQ will be confirmed in your quotation.

4. Inquiries and Orders

4.1 Inquiry Process

You may submit an inquiry through our website, email, live chat, or phone. We will respond with a quotation typically within 24 hours. The quotation includes product specifications, pricing, MOQ, and estimated lead time.

4.2 Order Confirmation

An Order is considered confirmed when:

• You provide written approval (email or signed document) of the quotation
• Sample design and specifications are approved
• The required deposit payment is received

Once confirmed, Orders cannot be cancelled without mutual agreement. Cancellation charges may apply based on production stage.

4.3 Order Modifications

Requests to modify a confirmed Order (quantity, design, specifications) must be submitted in writing. We will assess feasibility and may adjust pricing and lead time accordingly. Modifications may not be possible once production has begun.

5. Pricing and Payment

5.1 Pricing

All quotations are valid for 30 days from the date issued unless otherwise stated. Prices are quoted in USD (United States Dollars) unless specified otherwise. Prices do not include shipping, customs duties, taxes, or insurance unless explicitly stated.

5.2 Payment Terms

• Deposit: 30% of the total Order value is required as a deposit upon Order confirmation
• Balance: 70% balance is due before shipment, after production is completed and final product photos/videos are provided for inspection
• Sample fee: Custom sample fees are charged separately and may be refunded upon bulk Order confirmation

5.3 Accepted Payment Methods

• T/T (Bank Wire Transfer) — primary method for production Orders
• PayPal — accepted for samples and small Orders
• Western Union — accepted for Orders under USD 5,000
• Letter of Credit (L/C) — accepted for Orders exceeding USD 30,000

6. Sampling

Before mass production, we provide samples for your approval:

• Stock samples: Free of charge; shipping cost borne by the Customer
• Custom samples: A sample fee applies (USD 50–200 depending on complexity), refundable upon bulk Order confirmation
• Sample lead time: 3–7 working days after design confirmation

Mass production begins only after written sample approval from the Customer. We are not liable for Products produced according to approved samples that later prove unsuitable for the Customer's intended use.

7. Production and Delivery

7.1 Production Lead Time

Standard production lead time is 7–15 working days after sample approval and deposit receipt. Lead time may vary based on:

• Order quantity and product complexity
• Material availability and sourcing
• Printing and finishing processes required
• Production schedule at the time of Order confirmation

We will communicate an estimated completion date with each quotation. Rush production is available with an additional fee.

7.2 Shipping Methods

• Express courier: DHL, FedEx, UPS (3–7 days) — for samples and small Orders
• Air freight: 5–10 days — for urgent medium Orders
• Sea freight: 20–40 days — for large bulk Orders (most economical)

7.3 Shipping Responsibility

Unless otherwise agreed, shipping terms are FOB Xiamen. The Customer is responsible for import duties, customs clearance, and local transportation in the destination country. We will provide necessary documentation (commercial invoice, packing list, CO, etc.) to facilitate customs clearance.

7.4 Delivery Delays

We are not liable for delays caused by factors beyond our reasonable control, including but not limited to: natural disasters, government actions, customs delays, carrier failures, material shortages, or force majeure events. We will notify you promptly of any anticipated delays.

8. Quality and Inspection

8.1 Quality Standards

All Products are manufactured in compliance with ISO 9001 quality management standards. Our QC process includes raw material inspection, in-line production checks, and final pre-shipment inspection.

8.2 Pre-shipment Inspection

Before shipment, we provide product photos and/or videos for your review. You may also arrange a third-party inspection (SGS, Intertek, etc.) at your expense. Please notify us of inspection arrangements at least 3 days before the expected shipment date.

8.3 Defects and Claims

• Quality claims must be submitted within 7 days of receiving the Products, accompanied by clear photos of the defects
• We will assess each claim and offer replacement, credit, or refund for confirmed defects attributable to our production
• Normal printing variations (color tolerance within Delta E ≤ 3), minor scratch marks from transit, and issues arising from improper Customer storage are not considered defects
• Claims for damage during transit should be filed directly with the carrier

9. Returns and Refunds

As Products are custom-manufactured to your specifications, returns are generally not accepted except in cases of confirmed production defects. For defective Products:

• Replacement: We will produce and ship replacement Products at no additional cost
• Partial refund: A proportional refund may be issued for minor defects that do not render Products unusable
• Full refund: Issued only when the entire Order is confirmed defective and replacement is not feasible

Refunds will be processed using the original payment method within 15 working days of claim approval.

10. Intellectual Property

10.1 Our Content

All content on our Site, including text, graphics, logos, images, product designs, and software, is the property of ElkPackPro or its content suppliers and is protected by international copyright and trademark laws. You may not reproduce, distribute, or create derivative works without our prior written consent.

10.2 Customer Artwork and Designs

You retain all intellectual property rights to artwork, designs, and branding materials you provide for custom production. You warrant that you have the legal right to use all submitted artwork and indemnify us against any intellectual property claims arising from your submitted designs.

10.3 NDA and Confidentiality

We offer Non-Disclosure Agreements (NDAs) for sensitive projects. Even without a signed NDA, we treat all Customer project information as confidential and do not display custom Products in our portfolio without explicit permission.

11. Limitation of Liability

To the maximum extent permitted by law:

• ElkPackPro shall not be liable for any indirect, incidental, special, or consequential damages arising from the use of our Products or services
• Our total liability for any claim arising from these Terms shall not exceed the total amount paid by you for the specific Order giving rise to the claim
• We are not liable for business losses, including loss of profits, revenue, data, or goodwill, resulting from product defects or delivery delays
• We are not liable for damages caused by misuse, improper storage, or unauthorized modification of our Products by the Customer or end users

12. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the People's Republic of China, without regard to conflict of law principles.

In the event of any dispute arising from these Terms or our services, the parties shall first attempt to resolve the matter through good-faith negotiation. If resolution cannot be reached within 30 days, the dispute shall be submitted to arbitration in Xiamen, China, in accordance with the rules of the China International Economic and Trade Arbitration Commission (CIETAC). The language of arbitration shall be English.

13. Force Majeure

Neither party shall be held liable for failure or delay in performance caused by events beyond their reasonable control, including but not limited to: natural disasters, epidemics, war, terrorism, government actions, labor disputes, material shortages, transportation disruptions, or other force majeure events. The affected party shall notify the other party within 7 days and make reasonable efforts to resume performance.

14. Changes to Terms

We reserve the right to modify these Terms at any time. Updated Terms will be posted on this page with a revised "Last Updated" date. Your continued use of our Site and services after changes take effect constitutes acceptance of the revised Terms.
